What's the difference between a marriage licence and a marriage certificate?
A licence is your permission to marry, issued by the government BEFORE the ceremony. A certificate is the official proof the marriage happened, issued AFTER the ceremony by the provincial registry. You need the licence to have the ceremony; the certificate is what you use for tax, immigration, and estate purposes.
Do I need a lawyer to get married abroad?
Not for the ceremony itself. You may need one for: cross-border prenups, divorce-recognition issues, foreign-document legalization, or complex asset situations. For a straightforward destination wedding, a good wedding planner plus this guide is usually enough. When in doubt, a $150 fixed-fee consultation catches what matters.
How do I know if my foreign marriage is legal in Canada?
If the marriage was legal under the laws of the country where it was performed, Canada generally recognizes it — but you must REGISTER it with your provincial registry after returning. Without that step, CRA, IRCC, and provincial pension systems don't see you as married. This is the single most-forgotten step for Canadians marrying abroad.
What is a Statement in Lieu of Non-Impediment?
A sworn affidavit confirming you are legally free to marry, used by Canadians marrying in countries that require a Certificate of Non-Impediment. Canada does NOT issue CNIs, so the Statement in Lieu is its accepted substitute. Notarized in Canada ($50) or at a Canadian consulate abroad.
Can I get a prenup AFTER I'm already married?
Yes. Ontario's Family Law Act recognizes both pre-marriage and post-marriage contracts (called marriage contracts regardless of timing). Formality requirements are the same. Courts scrutinize post-marriage contracts more closely, especially if they disadvantage the lower-earning spouse.
Is a destination wedding officiant legal for Canadians?
The officiant must be legally recognized in the COUNTRY where the ceremony happens — not in Canada. An Italian civil servant at the commune is legal. A beach minister with no local accreditation is usually NOT legal. Ask for proof of local registration before booking.
